CHAPTER 2 – DEMOCRACY, RULE OF LAW AND NATIONAL DEVELOPMENT
2.1 DEFINITIONS AND CORE CONCEPTS
The term democracy is derived from the Greek word demokratia, meaning “rule of the people.”
It is coined from:
- Demos – people
- Kratos – authority or power
Democracy originated from the ancient Greek city-states.
Abraham Lincoln, a former President of the United States, defined democracy as:
“Government of the people, by the people and for the people.”

Representative Democracy
Representative democracy is a system of government in which citizens elect representatives to govern on their behalf. It is opposed to autocracy and direct democracy.
In this system:
- Citizens delegate authority to elected officials.
- Decisions are taken based on the will of the majority, while the minority still has a voice.
- Government is formed by the majority of the people.
2.2 CHARACTERISTICS OF REPRESENTATIVE DEMOCRACY
- Periodic Free and Fair Elections:
Citizens elect leaders at regular intervals and can remove non-performing leaders. - Supremacy of the Constitution:
The constitution (written or unwritten) is the highest law of the land and binds both the government and the governed. - Rule of Law:
All citizens are equal before the law. No one is above the law. - Independent Judiciary:
The judiciary must be free from the influence of the executive and legislature. - Political Equality:
Qualified citizens have the right to vote and be voted for. - The Will of the People:
Government policies reflect the wishes and interests of the people. - Separation of Powers:
Powers are shared among the executive, legislature, and judiciary with checks and balances. - Multi-Party System:
Multiple political parties compete for political power. - Freedom of the Press:
The press monitors government actions and informs the public. - Tolerance of Opposition:
Opposition parties are allowed to criticize government policies. - Accountability of Government:
Government must be transparent, responsible, and answerable to the people. - Fundamental Human Rights:
Rights such as freedom of speech, movement, religion, life, and property are guaranteed.

- Promotion of peace and security

2.4 MEANING AND ORIGIN OF THE RULE OF LAW
The rule of law means that government actions must be carried out according to the law, not personal wishes or abuse of power.
The doctrine was propounded by Professor A. V. Dicey in his book “Introduction to the Law of the Constitution” (1885).
2.5 PRINCIPLES OF THE RULE OF LAW
- Supremacy of the Law:
The law is the highest authority. Both rulers and the ruled are subject to it. - Equality Before the Law:
All persons, regardless of status or position, are treated equally. - Right to Personal Liberty:
Fundamental rights such as life, speech, association, and movement are protected.

- Ensures independence of the judiciary
- Guarantees supremacy of the law
- Provides equal protection for all citizens
- Prevents unjust punishment

The rule of law protects citizens from arbitrary use of power and ensures equality and justice.

2.12 LIMITATIONS OF LIBERTY
Liberty is not absolute. During emergencies such as war or curfew, some rights may be suspended to maintain public order and security.

Democracy operates on the principle of majority rule, where the group with the highest votes forms the government.
However, democracy must also protect minority rights to prevent oppression and dictatorship.
